DePuy ASR Hip Failure Recall

I am fielding many calls from concerned plaintiffs from all over the United States, regarding their implanted DePuy ASR Metal on Metal Hip implant, including Texas, California, Illinois, Florida and New York.

DePuy Hip Replacement and Recall

If you or a loved one has suffered as the result of a defective hip replacement, contact the Dr Shezad Malik law firm. Those who have had defective hip replacement systems implanted may be eligible to seek compensation for things like pain, suffering, medical expenses, lost income and disfigurement.

DePuy Hip Implant Failure Claims

The Depuy ASR Hip Replacement System has a high failure rate due to its defective design and manufacturing.

The company issued a voluntary recall of its hip replacement system in August 2010, as the defective implant has been associated with releasing high levels of metal ions of Cobalt and Chromium, which can damage the hip bone, hip tissue and can cause pseudo tumors.

If you have had a hip replacement after 2003 and are experiencing pain, it is important to contact your surgeon or the hospital where your surgery was performed to determine if a Depuy ASR Hip Replacement System was used.

What is Cobalt Poisoning Metallosis?

Has your metal-on-metal hip implant failed prematurely? Have you suffered from pain, inflammation, difficulty walking, or developed non-cancerous tumors since receiving your metal-on-metal hip implant?

You could be the victim of cobaltism, or cobalt poisoning, from your metal-on-metal hip implant. This occurs when the metal components of an implant begin to wear and microscopic metal debris are absorbed into the blood stream and infiltrate the organs.

The tissue damage that results from cobalt poisoning can complicate future revision surgeries intended to replace the damaged metal-on-metal hip implant.

Some defective metal devices sold in the US include Wright Medical’s CONSERVE Total Hip System, Biomet’s M2a Metal Hip, Zimmer Orthopedics’ Metasul, and DePuy Orthopaedic’s now-recalled ASR XL Acetabular Hip Replacement System and can lead to cobaltism and metallosis.

In a product liability case, a victim can recover economic damages (medical bills and lost wages) and non-economic damages (such as pain and suffering).

As a medical doctor I am concern about the risks of Cobalt and Chromium poisoning, resulting from the metal on metal grinding of the DePuy ASR Prosthetic Hips.

In August 2010, DePuy Orthopaedics Inc., recalled the ASR metal-on-metal hip replacement system, admitting that about one out of every eight patients who receives the hip implant may experience early hip failure within five years.

The actual ratio of defective hips may be as high as one out of five or 20%, or even higher.

Structural design and manufacturing problems with the DePuy metal-on-metal hip replacement system allow the toxic release of chromium and cobalt to be absorbed into the blood-stream.

Tests have demonstrated that levels of chromium and cobalt can be 100 times higher than normal, and the patients have had soft tissue and muscle inflammation and benign tumors develop, called pseudo-tumors.

Chromium and Cobalt toxicity has been linked to cancer, and other severe medical conditions associated with heavy metal toxicity.

DePuy ASR Lawsuits are consolidated in Ohio

The MDL is formed in the Northern District of Ohio, and all federal cases filed in different districts throughout the United States are consolidated and coordinated by one judge for handling during pretrial litigation.

Scope of DePuy ASR Problems

Approximately 36,000 DePuy hips have been implanted in the US alone. There is a Fort Worth Texas, orthopedic group that I know of, which has implanted 800, over the past 6 years.

I would encourage all patients who have had a DePuy hip implanted to seek legal advice, and to safeguard their legal rights.

If you have one of the DePuy ASR hip systems, you have the potential of a legal claim. Potential recoveries include compensation for your medical bills, lost wages and your pain and suffering.

DePuy MDL Lawsuits

Lawsuits filed by patients who were implanted with a DePuy hip replacement device have alleged that the company knew about problems with its products more than two years before they were finally recalled.

DePuy Orthopaedics and its parent company, Johnson & Johnson, recalled the ASR XL Acetabular System and ASR Hip Resurfacing Systems in August 2010 after studies showed that they were more than twice as likely to fail as similar hip replacement implants.

FDA Adverse Reports

Since 2008, the Food and Drug Administration received at least 400 reports of problems with DePuy hip replacement devices.

Studies conducted in the U.K. showed that within five years of receiving the devices, 13% of patients with the acetabular system and 12% of patients with the resurfacing system required surgery to fix their devices.

According to the company, only 5% of hip implants should need to be replaced within five years.
